Overview

This website and online store are operated by Piece Of Time Honolulu LLC ("we," "us," "our"). Our store is hosted by Shopify. These Terms govern your access to our website and your purchase of products from us. By visiting our website, submitting information, or purchasing, you agree to these Terms and to our Privacy Policy, Refund Policy, and Shipping Policy. Do not use our website or purchase from us if you do not agree.

1. Eligibility and Account Information

You represent that you are at least the age of majority where you live and are able to enter a binding agreement. You agree to provide complete, current, and accurate information when ordering or inquiring, and you are responsible for any activity under your account credentials.

2. Pre-Owned and Vintage Products

Many items we sell are vintage, pre-owned, collectible, or previously serviced. Signs of age, previous use, polishing, replacement parts, bracelet stretch, patina, scratches, and wear may be present and are not defects when disclosed in the listing or visible in the photos. Product photographs are part of the description—review all photos, measurements, and condition notes before buying.

Unless stated otherwise: measurements are approximate; service history is provided only when known; originality of every component is not guaranteed; a watch may contain manufacturer service parts or appropriate replacements; water resistance is not guaranteed; vintage watches should not be exposed to water, moisture, shock, or magnetism without testing; and timekeeping may vary with age, movement, position, temperature, power reserve, and wear. Contact us before purchasing if you need more photos, measurements, or clarification.

3. Authenticity and Brand Relationships

We do not knowingly sell counterfeit products. Watches are evaluated before listing and represented according to the information available to us. Unless stated otherwise, we are an independent watch dealer and are not an authorized dealer, agent, or representative of Rolex, Cartier, Omega, Patek Philippe, Audemars Piguet, or any other manufacturer. Brand names, models, logos, and trademarks belong to their owners and are used only to describe products for sale.

4. Product Availability

Most watches are one-of-a-kind. Adding an item to your cart does not reserve it, and items may be listed on other sales channels at the same time. Availability is not guaranteed until your order is accepted and payment confirmed. We may limit quantities, discontinue products, correct inventory errors, decline or cancel orders, and restrict sales to certain buyers or regions—including to comply with U.S. export controls, sanctions, and trade laws (such as those administered by OFAC). If we cannot fulfill an order that has already been paid, we will refund it.

5. Orders and Acceptance

Submitting an order is an offer to purchase. An automated confirmation means we received your order, not that we accepted it. We may review orders for payment authorization, shipping accuracy, fraud, and availability. An order is accepted when we confirm the sale or ship it. We may decline or cancel an order if a product is unavailable; pricing or listing information is materially wrong; payment cannot be verified; billing or shipping details are incomplete or inaccurate; we suspect fraud or unlawful activity; shipping or insurance is unavailable for the destination; or fulfillment would violate law, sanctions, export controls, or carrier rules. If we cancel after payment, we refund the original payment method.

6. Cancellations

Contact us immediately to request a cancellation. Requests are not guaranteed once an order is accepted, packaged, or shipped; shipped orders are handled under our Refund Policy. We may deduct non-refundable costs only where permitted by law and disclosed before purchase.

7. Prices, Taxes, and Payment

Prices may change without notice; the price charged is the one displayed and confirmed at checkout, subject to correction of obvious errors. Unless stated otherwise, prices exclude sales/use taxes, shipping, insurance, import duties, customs and brokerage fees, foreign transaction fees, and other government or bank charges. Applicable taxes are based on the transaction and delivery location. You represent that you are authorized to use your payment method. Payment must be verified before we ship or release an item, and we may request additional identity, payment, or address verification for high-value transactions.

8. Chargebacks and Payment Disputes

If you believe a charge is wrong or unauthorized, please contact us first—this usually resolves the issue faster. You agree not to file a chargeback in bad faith or for matters our Refund Policy addresses through returns, and filing a chargeback does not remove your obligation to return a product under that policy. We may contest chargebacks we believe are unwarranted and share transaction records with the processor or card network. Nothing here limits any dispute right you have under law or card-network rules.

9. Shipping and Delivery

We ship within the U.S. and to select international destinations. Accepted shipments are packaged carefully and sent with tracking and insurance for the declared purchase value, subject to carrier and insurance limits. Signature confirmation is required where available. We do not ship to P.O. boxes unless approved in advance.

Domestic delivery is generally 2–5 business days after shipment; international times vary with destination, carrier, and customs. Delivery dates are estimates, not guarantees. If we cannot ship within the promised timeframe, we will seek your consent to a delay or offer a cancellation and refund, consistent with federal rules requiring shipment within the stated time or, if none is stated, within 30 days unless you agree to a delay.

You are responsible for providing a complete, secure address. We are not responsible for delays or losses caused by an incorrect or incomplete address you supplied, refusal or failure to accept delivery, unpaid import charges, delivery instructions that waive a signature, unauthorized redirection you requested, customs or government holds, or events outside our reasonable control. Contact us immediately about a missing, delayed, damaged, or suspicious shipment, and cooperate with any carrier or insurance investigation. Responsibility for the product transfers to you after confirmed delivery to the approved address, except where law provides otherwise.

10. International Orders

International buyers are responsible for confirming a product may legally be imported and for all duties, VAT, taxes, customs and brokerage fees, and other destination-country costs. We will not declare a false value, mark a purchase as a gift, provide inaccurate customs information, or alter documents to avoid taxes or import requirements. International shipments may be delayed, inspected, held, or rejected by customs—circumstances generally outside our control. A refused shipment may incur return shipping, insurance, customs, storage, and brokerage charges, and any permitted refund may be reduced by costs not refunded to us, to the extent allowed by law and disclosed in our Refund Policy.

11. Local Viewings and Pickup

Local viewing or pickup may be available in Honolulu, Hawaiʻi, by appointment. Appointments are not guaranteed and may require identity or payment verification. We may choose the meeting location and set reasonable security procedures. An item is not reserved for a viewing without a separate written agreement or deposit.

12. Returns and Refunds

Returns are governed by our posted 30-Day Refund Policy, incorporated into these Terms. A return must be requested within 30 days after you receive the product, in the same condition delivered, with all packaging, accessories, tags, box, and papers. A returned watch must not have been worn beyond reasonable inspection, damaged, exposed to moisture, sized, altered, polished, opened, disassembled, serviced, magnetized, or swapped with different components or packaging. Returns sent without prior authorization may not be accepted. Refunds are issued only after we receive and inspect the item; signs of added wear, damage, alteration, missing components, or a changed condition may result in rejection or a reduced refund where permitted by law. Final-sale items are non-returnable only when clearly identified as final sale before purchase. Gift cards are subject to applicable law. Review the full Refund Policy before purchasing.

13. Damaged or Incorrect Products

Inspect your order promptly. Contact us immediately at pieceoftimehnl@gmail.com if the package arrives damaged, the product was damaged in shipping, you received the wrong item, the product materially differs from its listing, or included items are missing. Retain the product, packaging, box, labels, and materials while we review. Nothing here limits remedies that cannot lawfully be limited.

14. Warranties and Service

Any written warranty offered with a watch will be described in the listing, invoice, warranty document, or written agreement. Except where a written warranty is provided, and unless the law requires otherwise, no separate service, manufacturer, water-resistance, or accuracy warranty is included. Where we provide a written warranty on a product, implied warranties on that product are not disclaimed and, to the extent permitted by law, last for the period of that written warranty. Opening, servicing, polishing, altering, damaging, or exposing a watch to water may void any written warranty we provide. Manufacturer warranties may not transfer with a pre-owned product, and we do not control manufacturer or third-party service policies. "Support beyond the sale" means reasonable customer-service guidance, not a lifetime repair or service obligation.

15. Sell and Trade Inquiries

Any quote from photos or descriptions is preliminary and non-binding. A final purchase or trade offer is made only after we receive and inspect the watch, and we may revise or withdraw a quote based on authenticity, condition, function, missing components, undisclosed damage, ownership concerns, or other findings. By submitting a watch, you represent that you are the lawful owner or authorized by the owner; the watch is not stolen or subject to any lien, claim, or dispute; your information is accurate to the best of your knowledge; and you will disclose known defects, modifications, replacement parts, and service history. Additional terms may apply before a transaction closes.

16. Intellectual Property

The website and its original content—photographs, descriptions, graphics, logos, videos, layout, and branding—are owned by or licensed to us and protected by law. You may use the website for personal, non-commercial shopping only. Without our written permission, you may not reproduce, download, copy, republish, distribute, scrape, modify, sell, or commercially exploit our content.

17. Reviews, Photographs, and Submissions

When you submit a review, testimonial, photo, suggestion, or other content, you represent you have the right to provide it. Unless agreed otherwise in writing, you grant us a non-exclusive, worldwide, royalty-free license to reproduce, display, edit, and use it for our business and marketing. We need not publish, keep, or respond to submissions and may remove content that is unlawful, misleading, abusive, infringing, or inappropriate.

18. Prohibited Uses

You may not use the website for unlawful or fraudulent purposes; to violate laws; to infringe intellectual-property or privacy rights; to submit false information; to transmit malware or harmful code; to interfere with site security or function; to impersonate another person or business; to harvest customer or business information; to place orders with unauthorized payment information; or to conduct automated scraping without written permission. We may restrict or terminate access if we reasonably believe these Terms have been violated.

19. Third-Party Services and Links

Our website may link to or integrate with third-party services, including Shopify, payment providers, carriers, and social platforms. We do not control and are not responsible for their content, availability, privacy practices, or conduct, and their use may be subject to separate terms.

20. Privacy and Communications

Our handling of personal information is governed by our Privacy Policy. Depending on where you live, you may have rights under the California Consumer Privacy Act (as amended) or, in the EEA/UK, the GDPR; our Privacy Policy explains these. Because our store is hosted by Shopify, information may also be processed by Shopify and providers handling payments, fraud prevention, shipping, analytics, and operations. By providing your phone number you consent to transaction-related communications about your order; we send marketing calls or texts only if you separately opt in, and you can opt out anytime. Message and data rates may apply.

21. Errors and Corrections

Our website may contain typographical errors, inaccurate descriptions, wrong prices, inventory discrepancies, or omissions. We may correct errors, update information, or cancel an affected order, and if we cancel an accepted order due to our error we refund amounts collected. We are not obligated to update historical information unless required by law.

22. Disclaimer of Warranties

Except for warranties expressly provided in writing, and to the fullest extent permitted by law, the website and its services are provided on an "as available" basis, and we do not guarantee they will be uninterrupted, secure, or error-free. Products are sold according to their descriptions and disclosed conditions. To the fullest extent permitted by law, we disclaim warranties not expressly stated in writing, including implied warranties of merchantability or fitness for a particular purpose. These disclaimers do not apply to any product for which we provide a written warranty, to the extent the Magnuson-Moss Warranty Act or other law prohibits disclaiming implied warranties on it. Nothing here excludes any warranty or consumer right that cannot lawfully be excluded, and some jurisdictions do not allow certain exclusions, so some may not apply to you.

23. Limitation of Liability

To the fullest extent permitted by law, Piece Of Time Honolulu LLC and its owners, employees, contractors, agents, and providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or a transaction. Our total liability for any product or transaction will not exceed the amount you paid us for it. Where liability cannot be excluded or limited, it is limited to the maximum extent permitted by law. Nothing here limits liability for fraud, intentional misconduct, or any liability that cannot legally be limited.

24. Indemnification

You agree to indemnify and hold harmless Piece Of Time Honolulu LLC and its owners, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable legal expenses arising from your unlawful use of the website, your material breach of these Terms, your violation of another party's rights, or false ownership or condition representations in a sale or trade submission—only to the extent permitted by law.

25. Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, labor disputes, carrier or supplier failures, utility or telecom outages, cyberattacks, government actions, customs delays, or public-health emergencies. If such an event prevents or delays an order, we may arrange a delay, substitute, or cancellation and refund.

26. Electronic Communications

By using this website or transacting with us, you consent to receive communications electronically and agree that electronic communications, agreements, confirmations, and records satisfy any legal requirement that they be in writing. You may withdraw consent for non-transactional communications as described in our Privacy Policy, though this may affect certain services.

27. Termination of Access

We may restrict, suspend, or terminate your access to the website at any time when we reasonably believe these Terms have been violated, to protect our business or customers, or as otherwise permitted by law.

28. Dispute Resolution

If a dispute arises, you agree to first contact us at pieceoftimehnl@gmail.com with a brief description and the resolution you seek, and both parties will try in good faith to resolve it informally for at least 30 days before starting formal proceedings. This does not prevent either party from seeking relief for intellectual-property infringement or in small-claims court, and does not waive any right that cannot legally be waived.

29. Governing Law and Venue

These Terms are governed by the laws of the State of Hawaiʻi and applicable federal law, without regard to conflict-of-law principles. Subject to rights that cannot legally be waived, disputes will be brought in a state or federal court in Honolulu, Hawaiʻi, and the parties consent to those courts' jurisdiction. This does not deprive you of mandatory consumer protections of your place of residence that cannot be waived.

30. General

If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted or severed, and the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies incorporated into them are the entire agreement for use of the website and online purchases, except where a separate written invoice, sales agreement, warranty, or transaction-specific agreement applies—in which case the more specific terms control for that transaction to the extent of any direct conflict. We may update these Terms by posting a revised version; changes apply from the new effective date and do not retroactively alter completed transactions unless required by law. Continued use after an update means you accept the revised Terms.
